These Terms & Conditions govern the use of the BetterNest Realty website and any related forms, tools, or services provided prior to execution of a formal listing agreement.

1. Scope of Services Offered

BetterNest Realty currently offers the following limited and flat-fee real estate services, which may include but are not limited to:

• Try Before You Hire

• Six Month Saver

• Market Ready Flat-Fee Listing Services

Details of each service, including pricing and inclusions, are described on the website and may vary by program.

BetterNest Realty may also offer traditional full-service brokerage services. All full-service listings are governed exclusively by a separate written listing agreement and required disclosures. These Terms & Conditions do not replace, amend, or override any listing agreement.

2. Intake Forms & Submissions

​

Any information submitted through website forms is provided for information-gathering and service evaluation purposes only.

Submission of a form:

• Does not create a listing agreement

• Does not establish an agency relationship

• Does not guarantee MLS entry, pricing approval, or service acceptance

Required agreements, disclosures, and authorizations will be executed separately via Authentisign or other approved electronic signature platforms.

3. No Agency Relationship Until Agreement Is Signed

​

No real estate brokerage relationship is created unless and until a written listing agreement is fully executed by all parties.

Until such time:

• BetterNest Realty is not acting as the seller’s agent

• No fiduciary duties are owed

• Any guidance provided is general and informational in nature
   

4. Seller Representations

By submitting information through this website, you represent that:

• You are the property owner or have authority to act on behalf of the owner

• All information provided is accurate to the best of your knowledge

• You understand that inaccurate or incomplete information may delay or prevent services
   

5. Limitation of Liability

​

To the fullest extent permitted by Florida law:

• BetterNest Realty is not liable for indirect, incidental, or consequential damages

• Liability, if any, is limited to the amount of fees paid for the applicable service

• BetterNest Realty is not responsible for outcomes related to market conditions, buyer behavior, pricing decisions, or seller-provided information
   

6. Third-Party Platforms & Services

BetterNest Realty may utilize third-party platforms including but not limited to MLS systems, electronic signature services, and marketing tools. BetterNest Realty is not responsible for service interruptions, errors, or limitations caused by third-party providers.

7. Modifications & Availability

​

Services, pricing, and offerings may be modified, suspended, or discontinued at any time prior to execution of a listing agreement.

8. Governing Law & Venue

​

These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in a court of competent jurisdiction within the State of Florida.

9. Acceptance of Terms

By using this website or submitting any form, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
