Flat-Fee General Terms & Conditions

1. Nature of Services

 

BetterNest Realty provides administrative real estate services, including MLS listing entry, coordination, and related support, depending on the plan selected. Unless expressly stated otherwise, BetterNest Realty does not provide full-service real estate brokerage representation, legal advice, or fiduciary services.

​

The seller remains responsible for all decisions related to pricing, negotiations, disclosures, contracts, and acceptance of offers.

​

2. Seller Responsibilities

 

By using BetterNest Realty services, the seller agrees to:

​

  • Provide accurate, complete, and truthful information

  • Comply with all applicable federal, state, and local laws

  • Comply with MLS rules, HOA requirements, and disclosure obligations

  • Review all listing data for accuracy prior to activation

  • Some information may be pre-filled using public records and prior listings. Seller is responsible for confirming accuracy before the listing goes live
     

BetterNest Realty is not responsible for errors, omissions, delays, or consequences arising from inaccurate or incomplete seller-provided information.

3. MLS Rules & Limitations

​

All listings are subject to MLS approval, compliance rules, and system limitations. BetterNest Realty does not control and is not responsible for:

​

  • Listing acceptance or rejection by the MLS

  • Days on Market (DOM) or Cumulative Days on Market (CDOM)

  • Historical data retention

  • Syndication timing or display on third-party websites

​

MLS rules govern all listing statuses and changes.

​

4. Processing Timeframes

​

BetterNest Realty processes listing submissions, updates, status changes, and MLS withdrawal requests within one (1) business day, excluding weekends and recognized holidays, provided all required information has been received and is MLS-compliant.

Processing timelines do not guarantee MLS approval or same-day public visibility.

5. No Guarantee of Results

​

BetterNest Realty makes no guarantees regarding:

​

  • Sale price

  • Time on market

  • Buyer interest

  • Listing performance or exposure

​

Real estate outcomes depend on market conditions, pricing strategy, property condition, and seller responsiveness.

6. Third-Party Services

​

Certain services, including but not limited to photography, may be provided by independent third-party vendors. BetterNest Realty’s role in such services is limited to coordination unless otherwise stated.

​

BetterNest Realty is not responsible for third-party vendor availability, performance, delays, cancellations, or outcomes.

​

7. Limitation of Liability & Indemnification

​

Limitation of Liability
To the maximum extent permitted by law, BetterNest Realty’s total liability arising out of or relating to any services provided shall be limited to the amount of fees paid by the seller for the applicable service. In no event shall BetterNest Realty be liable for indirect, incidental, special, or consequential damages, including loss of profits, loss of opportunity, or loss of market value.

Indemnification

The seller agrees to indemnify and hold harmless BetterNest Realty from and against any claims, losses, damages, liabilities, costs, or expenses arising from the seller’s actions, omissions, inaccurate information, failure to disclose, or failure to comply with applicable laws, MLS rules, or contractual obligations.

​

8. Modifications to Terms

​

BetterNest Realty reserves the right to update or modify these Terms & Conditions with notice. Continued use of services after such modifications constitutes acceptance of the revised terms.

​

9. Governing Law

​

These Terms & Conditions shall be governed by and construed in accordance with the laws of the state in which the property is located, unless otherwise required by law.

​

10. Acceptance of Terms

​

By purchasing or using any BetterNest Realty service, the seller acknowledges that they have read, understood, and agreed to these General Terms & Conditions, as well as the plan-specific terms applicable to their selected service.

Try Before You Hire - Terms & Conditions

BetterNest Realty

Try Before You Hire - Monthly Flat-Fee Listing

Plan-Specific Terms & Conditions

 

1. Service Overview

​

The Try Before You Hire plan is a month-to-month flat-fee MLS listing service offered for $99 per month. This plan is designed for sellers who wish to market their property independently while receiving limited MLS access and administrative support.

​

This service does not constitute full-service real estate representation unless the seller upgrades to a higher-tier BetterNest service.

​

2. What Is Included

​

While the subscription is active, BetterNest Realty provides:

​

  • Entry of seller-provided listing information into the MLS

  • Syndication to third-party real estate websites, as permitted by the MLS

  • Maintenance of an active MLS listing during the paid subscription period

  • Administrative support related to listing entry and status changes

 

All listing content is based on information supplied by the seller.

​

3. What Is Not Included

 

Unless separately purchased or upgraded, this plan does not include:

​

  • Pricing guidance or comparative market analysis (CMA)

  • Professional photography, videography, or marketing materials

  • Yard signs, lockboxes, or showing coordination

  • Buyer screening or communication

  • Contract drafting, negotiation, or transaction management

  • Legal advice or representation

  • Attendance at inspections, appraisals, or closing
    ​

The seller is responsible for all negotiations, contracts, disclosures, and buyer interactions.

​

4. Seller Responsibilities

​

By enrolling in this plan, the seller agrees to:

​

  • Provide accurate, complete, and MLS-compliant listing information

  • Comply with all MLS rules, local laws, HOA requirements, and disclosure obligations

  • Respond directly to buyer and agent inquiries

  • Manage all negotiations and contractual matters independently

  • Some information may be pre-filled using public records and prior listings. Seller is responsible for confirming accuracy before the listing goes live
     

BetterNest Realty is not responsible for delays, errors, or omissions caused by incomplete or inaccurate seller-provided information.

​

5. Billing & Subscription Terms

​

  • The subscription fee is $99 per month, billed automatically on a recurring basis

  • Billing begins on the date of purchase, not the date the listing is submitted or activated

  • The subscription renews monthly on the purchase anniversary date

  • Fees are non-refundable once billed, including partial months
     

Delays in submitting listing information do not pause billing or extend the subscription period.

6. Listing Activation

 

The MLS listing is activated once the seller submits all required, accurate, and MLS-compliant information. BetterNest Realty does not guarantee same-day MLS activation, as timelines are subject to MLS review and processing rules.

​

7. Cancellation & MLS Removal

 

Sellers may cancel their subscription at any time through their account dashboard.

At the time of cancellation, the seller may select a requested MLS removal date, including:

​

  • Immediate removal

  • A future date specified by the seller

  • Removal at the end of the current billing period

 

BetterNest Realty will process MLS withdrawal requests in accordance with MLS rules and system processing timelines. MLS status changes may not occur instantly.

​​

8. Processing Timeframes

​

BetterNest Realty processes listing submissions, status changes, and MLS withdrawal requests within one (1) business day, excluding weekends and recognized holidays, provided all required information has been received and is MLS-compliant.

​

9. Effect of Cancellation

​​​

  • Cancellation stops future billing only

  • No refunds are issued for the current billing period, regardless of the selected MLS removal date

  • Subscription fees are not contingent on how long the listing remains active during the billing period
     

10. MLS Rules & Limitations

​

All listings are subject to MLS approval, compliance rules, and system limitations. BetterNest Realty does not control:

​​

  • Days on Market (DOM) or Cumulative Days on Market (CDOM)

  • Listing acceptance or performance

  • Historical data retention

​

MLS policies govern all listing statuses and timelines.

​​

11. No Guarantee of Results

​

BetterNest Realty makes no guarantees regarding:

​​

  • Sale price

  • Time on market

  • Buyer interest or activity

  • Listing visibility or performance

​

Real estate outcomes depend on market conditions, pricing, property condition, and seller responsiveness.

12. Independent Service Disclosure

​

Under this plan, BetterNest Realty provides administrative MLS listing services only. The seller is acting in a self-directed capacity unless additional services are purchased.

13. Limitation of Liability

​

BetterNest Realty’s liability is limited to the amount of subscription fees paid during the current billing period. Under no circumstances shall BetterNest Realty be liable for indirect, incidental, or consequential damages.

​​

14. Modifications & Upgrades

​

BetterNest Realty reserves the right to modify service offerings, pricing, or these Terms & Conditions with notice. Sellers may upgrade to other BetterNest services at any time, subject to separate terms and pricing.

15. Acceptance of Terms

 

By purchasing or continuing the Try Before You Hire subscription, the seller acknowledges that they have read, understood, and agreed to these Terms & Conditions.

Six Month Saver - Terms & Conditions

BetterNest Realty

Six-Month Saver Plan – Flat-Fee MLS Listing

Plan-Specific Terms & Conditions

 

1. Service Overview

 

The Six-Month Saver Plan is a one-time flat-fee MLS listing service that provides up to six (6) months of MLS exposure for a single property. This plan requires an upfront payment and does not renew monthly.

 

This service includes administrative preparation and listing entry services and does not constitute full-service real estate representation unless the seller upgrades to an additional BetterNest service.

 

2. What Is Included

 

Under the Six-Month Saver Plan, BetterNest Realty provides:

​

  • Review and preparation of seller-submitted listing data

  • Entry of listing information into the MLS

  • Syndication to third-party real estate websites, as permitted by the MLS

  • Maintenance of an active MLS listing for up to six (6) months, subject to MLS rules

  • Administrative support related to listing status changes during the term
     

3. What Is Not Included

 

Unless separately purchased or upgraded, this plan does not include:

  • Pricing analysis or comparative market analysis (CMA)

  • Professional photography, videography, or marketing materials

  • Yard signs or lockboxes

  • Showing coordination or buyer screening

  • Contract drafting, negotiation, or transaction management

  • Legal advice or representation

The seller remains responsible for all negotiations, contracts, disclosures, and buyer communications.

4. Seller Responsibilities

​

By purchasing this plan, the seller agrees to:

​

  • Submit complete, accurate, and MLS-compliant listing information

  • Respond promptly to requests for clarification or confirmation

  • Comply with all MLS rules, local laws, HOA requirements, and disclosure obligations

  • Information may be pre-filled using public records and prior listings. Seller is responsible for confirming accuracy before the listing goes live
     

Delays caused by incomplete or inaccurate seller information may delay MLS activation but do not affect the terms of this agreement.

5. Billing & Payment Terms

​​

  • The Six-Month Saver Plan is billed as a one-time, upfront flat fee

  • The discounted price reflects the seller’s commitment to the full six-month term over our monthly plan

  • All fees are non-refundable except as expressly stated in Section 7
     

6. Listing Preparation & Activation

 

After purchase, BetterNest Realty will review the seller’s submitted information and prepare the listing for MLS entry. BetterNest Realty will contact the seller to confirm listing details prior to activation.

MLS activation occurs only after seller confirmation and MLS compliance review. MLS processing timelines are governed by MLS rules and are not guaranteed to be same-day.

7. Cancellation Policy (Important)

​

Pre-Preparation Cancellation

The seller may cancel the Six-Month Saver Plan only if cancellation is submitted before either of the following occurs:

​

  • The MLS listing is entered or submitted for entry

  • BetterNest Realty contacts the seller to review or confirm listing data prior to activation
     

If cancellation is received before either event, the seller may be eligible for a refund less any non-recoverable processing fees, if applicable.

Post-Preparation / Post-Review Cancellation

 

Once BetterNest Realty has begun listing preparation, data review, or has contacted the seller to confirm listing details, the service is considered in progress, and the plan becomes non-cancelable and non-refundable, even if the listing has not yet gone live.

This reflects the administrative work performed in reliance on the seller’s purchase.

8. Early Withdrawal After Listing Is Live

 

If the seller requests withdrawal of the MLS listing after activation:

​

  • The listing will be withdrawn in accordance with MLS rules and processing timelines

  • No refunds or credits are issued for unused time

  • Early withdrawal does not convert the plan to a monthly service
     

9. Processing Timeframes

 

BetterNest Realty processes listing submissions, data reviews, status changes, and MLS withdrawal requests within one (1) business day, excluding weekends and recognized holidays, provided all required information has been received and is MLS-compliant.

10. MLS Rules & Limitations

 

All listings are subject to MLS approval, compliance requirements, and system limitations. BetterNest Realty does not control:

​

  • Days on Market (DOM) or Cumulative Days on Market (CDOM)

Market Ready Plan - Terms & Conditions

BetterNest Realty

Market Ready Plan – Flat-Fee MLS Listing

Plan-Specific Terms & Conditions

1. Service Overview

 

The Market Ready Plan is a one-time flat-fee MLS listing service designed to prepare a property for market with essential listing components completed on the seller’s behalf. This plan includes administrative preparation and coordination of third-party services.

This plan does not constitute full-service real estate representation unless expressly stated.

2. What Is Included

 

Under the Market Ready Plan, BetterNest Realty provides:

​

  • Review and preparation of seller-submitted listing information

  • Entry of listing information into the MLS

  • Syndication to third-party real estate websites, as permitted by the MLS

  • Coordination of professional real estate photography

  • Administrative support related to listing activation and status changes

 

Photography services are provided by an independent third-party vendor, not BetterNest Realty.

​

3. What Is Not Included

 

Unless separately stated, this plan does not include:

​

  • Pricing analysis or comparative market analysis (CMA)

  • Videography, drone photography, or floor plans unless specified

  • Yard signs or lockboxes unless specified

  • Showing coordination or buyer screening

  • Contract drafting, negotiation, or transaction management

  • Legal advice or representation
     

4. Seller Responsibilities

By purchasing this plan, the seller agrees to:

​

  • Submit complete, accurate, and MLS-compliant listing information

5. Third-Party Photography Disclosure

Professional photography may be performed by an independent third-party provider. In that instance, BetterNest Realty’s role is limited to scheduling and coordination.

BetterNest Realty is not responsible for:

​​

  • Photographer availability

  • Weather conditions

  • Vendor rescheduling policies

  • Image style preferences beyond standard real estate photography

​​

Any disputes regarding photography quality must be addressed directly with BetterNest Realty within a reasonable time after delivery.

​​

6. Billing & Payment Terms

​​​

  • The Market Ready Plan is billed as a one-time upfront flat fee

  • Payment is required before listing preparation or photography scheduling begins

  • Fees are non-refundable except as expressly stated in Section 7
     

7. Listing Preparation & Activation

​

Upon purchase, BetterNest Realty will begin listing preparation and coordinate photography scheduling. The seller may be contacted to confirm listing details prior to MLS activation.

​​

MLS activation is subject to seller confirmation, MLS compliance, and system processing timelines.

​​

8. Cancellation & Refund Policy (Important)

​

Pre-Work Cancellation
The seller may cancel the Market Ready Plan only if cancellation is submitted before any of the following occur:

  • Listing preparation has begun

  • Listing data has been reviewed or entered

  • Photography has been scheduled

​

If canceled prior to any work being performed, the seller may be eligible for a refund less any non-recoverable processing fees, if applicable.

​​

Photography-Related Cancellation

Once photography has been scheduled, the following applies:

  • Cancellations must be submitted at least twenty-four (24) hours prior to the scheduled photography appointment to be eligible for a refund of the photography portion of the fee

  • Cancellations made less than 24 hours before the scheduled photography session are non-refundable

  • No-shows for photography appointments are non-refundable

These policies reflect third-party vendor cancellation requirements.

Post-Preparation / Post-Photography Cancellation
Once listing preparation has begun or photography has occurred, the Market Ready Plan becomes non-cancelable and non-refundable, even if the listing has not yet gone live.

​

9. Early MLS Withdrawal

​

If the seller requests MLS withdrawal after activation:

​​

  • The listing will be withdrawn in accordance with MLS rules and processing timelines

  • No refunds or credits are issued for unused time

BetterNest Realty processes listing preparation, scheduling coordination, MLS submissions, and status changes within one (1) business day, excluding weekends and recognized holidays, provided all required information has been received and is MLS-compliant.

third-party vendor actions, delays, or cancellations.

By purchasing the Market Ready Plan, the seller acknowledges that they have read, understood, and agreed to these Terms & Conditions.

Agent Answers & Expert Review - Terms & Conditions

BetterNest Agent Answers & Expert Review

Terms & Conditions

 

1. Scope of Services

 

Agent Answers ($49) provides general real estate guidance in response to one specific question submitted by the user. Responses are delivered in writing by a licensed real estate professional, typically within one business day. This service is intended for general guidance, clarification, or interpretation of how common real estate practices may apply to the user’s situation.

 

This service does not include review of offers, contracts, addenda, inspections, appraisals, CMAs, pricing recommendations, negotiation strategy, or representation. 

​

Clarifying questions related to the original submission are permitted. New or unrelated questions require a separate submission.

 

Expert Review ($150) provides deeper, transaction-related guidance and may include review of offers, contracts, addenda, inspections, appraisals, negotiation strategy, or pricing guidance including comparable sales analysis. 

​

This service is advisory only and does not include full representation unless a separate written agreement is executed.

​

2. No Agency or Representation

​

Unless otherwise agreed to in writing, use of Agent Answers or Expert Review does not create an agency, fiduciary, or representation relationship. Users remain solely responsible for all decisions made based on the guidance provided.

​

3. User Information

​

All guidance is based solely on the information provided by the user. BetterNest is not responsible for outcomes resulting from incomplete, inaccurate, or omitted information.

​

4. Turnaround Time

​

Responses are typically provided within one business day (excluding holidays). Timing may vary due to volume or complexity.

​

5. Refund Policy

​

If the user believes the response did not adequately address the submitted question, a refund may be requested within 48 hours of delivery. Refunds apply only to the original submission. BetterNest may offer clarification before issuing a refund.

​

6. No Legal, Tax, or Financial Advice

​

Guidance provided is for informational purposes only and does not constitute legal, tax, or financial advice. Users are encouraged to consult qualified professionals for legal or contractual matters.

​

7. Limitation of Liability

​

BetterNest and its agents are not responsible for financial loss, missed opportunities, or outcomes resulting from reliance on the guidance provided.

​

8. Changes & Governing Law

​

BetterNest reserves the right to modify services or pricing at any time. 

​

These terms are governed by the laws of the state in which BetterNest is licensed.

​

9. Submission Window

​

Questions and review requests must be submitted within six (6) months of purchase. Unused questions or credits expire after this period and have no cash value.

Transaction Coordinator - Terms & Conditions

Terms & Conditions

1. Service Overview

​

BetterNest Realty’s Transaction Coordinator (TC) Services provide administrative support for real estate transactions under contract. These services are designed to assist with document management, deadline tracking, and communication coordination.

Transaction Coordinator services do not include real estate brokerage representation, legal advice, contract interpretation, negotiation, or decision-making authority.

2. Scope of Services

​

Transaction Coordinator services may include, depending on the package selected:

​

  • File setup and organization

  • Collection and submission of required transaction documents

  • Tracking and monitoring contract deadlines

  • Communication with parties regarding missing items or deadlines

  • Coordination with lenders, title companies, and other vendors

  • Compliance support based on provided documentation

​

Services are limited to administrative tasks only.

​

3. What Is Not Included

​

Transaction Coordinator services do not include:

​

  • Legal advice or contract interpretation

  • Negotiation of contract terms

  • Pricing guidance or strategy

  • Representation of any party

  • Resolution of disputes between parties

  • Responsibility for contract validity or enforceability

​

All decisions remain the responsibility of the buyer, seller, and/or their licensed real estate agent.

​

4. Seller / Agent Responsibilities

​

The client (agent or principal, as applicable) agrees to:

​

  • Provide complete, accurate, and timely documentation

  • Review all documents for accuracy

  • Ensure all contractual obligations are met

  • Respond promptly to requests for information or clarification

​

BetterNest Realty is not responsible for missed deadlines caused by delayed, incomplete, or inaccurate information provided by the client or third parties.

​

5. Processing Timeframes

​

BetterNest Realty processes transaction coordination tasks within one (1) business day, excluding weekends and recognized holidays, provided all required information has been received and is complete.

Processing timelines do not guarantee third-party performance or responses.

​

6. Third-Party Dependencies

​

Transaction timelines depend on third-party participants, including lenders, title companies, inspectors, and other vendors. BetterNest Realty is not responsible for delays, errors, or failures caused by third parties.

​

7. Fees & Payment Terms

​​

  • Transaction Coordinator services are billed according to the selected package or agreed-upon fee

  • Fees are earned upon commencement of services

  • Fees are non-refundable once services have begun

​

If a transaction terminates early, fees remain earned for services already performed unless otherwise agreed in writing.

​

8. No Guarantee of Outcome

​

BetterNest Realty does not guarantee:

​

  • Closing of the transaction

  • Timeline to closing

  • Approval of financing

  • Performance of any party

​

Transaction outcomes depend on factors outside BetterNest Realty’s control.

​

9. Limitation of Liability & Indemnification

​

Limitation of Liability
To the maximum extent permitted by law, BetterNest Realty’s liability arising out of or related to Transaction Coordinator services shall be limited to the amount of fees paid for those services. BetterNest Realty shall not be liable for indirect, incidental, special, or consequential damages.

Indemnification

The client agrees to indemnify and hold harmless BetterNest Realty from any claims, losses, damages, liabilities, or expenses arising from inaccurate information, missed deadlines caused by client action or inaction, contract disputes, or failure to comply with applicable laws or contractual obligations.

​

10. No Legal or Brokerage Relationship

​

Transaction Coordinator services do not create an attorney-client relationship, fiduciary relationship, or brokerage representation relationship.

​

11. Governing Law

​

These Terms & Conditions shall be governed by and construed in accordance with the laws of the state in which the property is located, unless otherwise required by law.

​

12. Acceptance of Terms

​

By engaging BetterNest Realty for Transaction Coordinator services, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
